Liability

22.1 To the extent that we are liable to you for breach of contract, negligence or any other liability arising under these Terms and Conditions, our liability shall at all times be capped at the Valuation of the Item(s) which is the subject of your claim.

22.2 We shall not be liable for any special indirect, punitive, incidental, special or consequential damages relating to your Contract with us. This includes but is not limited to direct and indirect loss of profit and loss of income.

22.3 Nothing in these Terms and Conditions shall exclude or limit our liability for:

a) death or personal injury caused by our negligence;

b) fraud or fraudulent misrepresentation;

c) any breach of the obligations implied by section 12 of the Sale of Goods Act 1979 or the Consumer Rights Act 2015; or

d) any other matter for which it would be illegal for us to exclude or attempt to exclude our liability.

22.4 Nothing in these Terms and Conditions shall affect your legal rights.
